Colorado Officials Defend Marijuana Laws in Supreme Court Brief

Colorado Attorney General Cynthia Coffman argued that the Supreme Court should reject a landmark lawsuit filed by Nebraska and Oklahoma over marijuana legalization earlier this week. In the brief submitted in response to the lawsuit, Ms. Coffman wrote that the two states “filed this case in an attempt to reach across their borders and selectively invalidate state laws”.
Nebraska and Oklahoma are looking to strike down Colorado’s licensing of recreational marijuana stores, arguing that they have caused an increase in marijuana trafficking into their respective states, stretching their law enforcement agencies and threatening their sovereignty. The lawsuit represents the first of its kind and a potentially dangerous precedent for the legalization movement.
Coffman argued that the lawsuit, if successful, would make the problem worse by involving the black market in all three states. Colorado’s regulations are designed to “channel demand away from this black market and into a licensed and closely monitored retail system”, according to Ms. Coffman, and circumventing that system would leave legalization laws without regulation of the supply.
The brief also points out that more than half of all states now have laws legalizing recreational or medical marijuana and many have done so with great success in the early stages. Interestingly, Ms. Coffman is a Republican that opposed the legalization of marijuana, but has been since tasked to defend it in court.
Washington and Oregon filed a friend-of-the-court brief last week in support of Colorado’s laws, arguing that they don’t hurt Nebraska or Oklahoma’s abilities to enforce their own laws.
