Nevada to Vote on Adult-Use Legalization in 2016

Nevada election officials approved an initiative for the 2016 ballot, which would permit adult-use marijuana. After securing nearly 247,000 signatures, Secretary of State Ross Miller certified that proponents of the separate measures submitted enough signatures by November 12th to force the 2015 Legislature to consider each issue and put them on the general election ballot automatically.

While Nevada has already legalized medical marijuana, the new measures would make private possession of up to an ounce of marijuana legal for people over the age of 21, putting it alongside Colorado, Washington, Oregon, Alaska, and Washington D.C. The Legislature may legalize adult-use cannabis as early as the end of the 2015 session or at least be put on the 2106 ballot where Nevadans would vote.

In 2013, Nevada approved a medical marijuana initiative designed to provide safe, regulated access to medical marijuana. The state’s health department finalized the program’s rules on April 1st and will soon regulate up to 66 medical marijuana dispensaries and cultivars, product manufacturers, and testing labs. The open application period has closed and firms were already selected.

The state is the 19th in the U.S. to decriminalize personal use of marijuana possession. While considered a decriminalized state, possession of marijuana can still be treated harshly, with a first offense punishable by a $600 fine instead of jail time, although it remains a misdemeanor. Second offenses can carry a $1,000 fine and drug addiction screening with worse penalties for future offenses.
